Acknowledgment of Vehicle Condition: I understand that my vehicle may have pre-existing wear, damage, or defects—whether known or unknown to me at the time of service. Voodoo Performance will perform an initial assessment where feasible, but I acknowledge that not all issues may be detectable prior to beginning work.
Scope of Work: Voodoo Performance agrees to perform the services requested as outlined in the Customer Intake Form or as agreed upon in writing. I understand that additional issues or failures may arise during the course of the work due to the condition of my vehicle, its age, mileage, modifications, or other factors beyond Voodoo Performance’s control.
No Liability for Pre-Existing or Consequential Damage: I agree that Voodoo Performance, LLC, its owners, employees, and affiliates are not responsible for any damage, failure, or breakage of components that occurs during or after service if such issues are determined to result from:
Pre-existing wear, damage, or defects in the vehicle.
The vehicle’s age, mileage, or overall condition.
Previous modifications or repairs performed by other parties.
Normal wear and tear or unforeseen mechanical stress during the service process.
Examples of Non-Liability: For example, if a rusted bolt breaks, a worn gasket fails, or a previously damaged component gives out while Voodoo Performance is working on my vehicle, I agree that Voodoo Performance is not liable for the repair or replacement of those parts unless caused by proven negligence or improper workmanship directly attributable to Voodoo Performance.
Customer Responsibility: I understand that it is my responsibility to disclose any known issues, modifications, or concerns about my vehicle prior to service. I also acknowledge that additional costs may arise if unforeseen issues are discovered, and Voodoo Performance will make reasonable efforts to notify me before proceeding with additional repairs (where practical).
Risk of Performance Modifications: If the requested services include performance upgrades (e.g., tuning, turbocharging, exhaust modifications), I acknowledge that such changes may increase stress on my vehicle’s components, potentially leading to failure of parts not directly modified by Voodoo Performance. I accept this risk and release Voodoo Performance from liability for such outcomes.
Hold Harmless Agreement: I agree to indemnify and hold harmless Voodoo Performance, LLC, its owners, employees, and affiliates from any claims, damages, or losses arising from the condition of my vehicle or the services performed, except in cases of proven negligence or willful misconduct by Voodoo Performance.
Authorization: I authorize Voodoo Performance to perform the requested services on my vehicle and understand the terms outlined in this waiver. I have had the opportunity to ask questions and seek clarification before signing.
